In Defense of My Smartphone – By a Generation Xer

On the second day of the Lawyers with Purpose Tri-Annual Practice Enhancement Retreat in Orlando, there was a focus session on the Infrastructure Track called “Bridging the Generation Gap,” presented by Susan Hunter. My presence there was mandatory, as I had been assigned to administrative duties as an employee of Lawyers with Purpose. However, it was also my treat, because I am a big fan of Susan’s presentations and knew I was in for an informative and humorous session – and I was right. Susan talked about the three generations that make up her law firm team: The Baby Boomers, Generation X, and the Millennials. She also explored the challenges and opportunities that may occur when working with someone not from your own generation, as well as the growth mindset needed to bridge this gap.

Bigstock-Apple-Iphone-With-Blank-Screen-29625881Among the various characteristics of the Millennials noted was their hyper-ease with technology, especially social media, predominantly via smartphones. It was cited that 98% of Millennials have a smartphone. And it is the smartphone that is usually blamed for promoting isolation and the decrease in face-to-face interactions in real time – not FaceTime. But, in defense of my smartphone, I found that I related more to the Millennials who work in our firm during this trip because of it than I think I would have otherwise. Don’t get me wrong, there was also plenty of good, old-fashioned team building in the form of conversations, brainstorming, card and board games, as well as one night with a home-cooked meal prepared by team members. However, I must confess that our smartphones did play an important part in bringing us together as a team.

My use – excuse me – our use of the smartphone during our road trip from Atlanta to Orlando as well as during the retreat was interactive. First and foremost, we used it to get information like researching recommended places to eat along I-75 or finding the cheapest gas when it was time to refuel. We also used the mapping capabilities of the smartphone extensively to direct us on our route, avoid traffic, and keep us up to date on our ETA despite the pit stops. Then there is what may be the default use of the smartphone: communication. Our firm stayed at a timeshare condo a few minutes from the hotel where the retreat occurred, and this required some coordination to accommodate the needs of all nine team members. We relied on text messages and calls to remain in contact and synchronize needed rides. During the road trip, we would also send regular text messages to Victoria, our supervisor, to give her status updates on our arrival both to Orlando and Atlanta.

Another way we communicated via smartphone was by sharing photos the team took. This included sharing funny pictures of Goofy and the team at the reception, but they also served to document our team’s work at the retreat, like the photo we shared of our completed, collaborative Brainstorming Sprints sheet. Lawyers with Purpose even provided a smartphone app called EventBoard for the retreat and the Practice with Purpose program. The app provides an interactive conference event guide with the schedule, speaker information, sponsors and their websites, floor plans, and online evaluation forms. I really like how the events grayed out on the schedule as the day went on so you could immediately see the highlighted current and upcoming sessions. Sure, there were technical difficulties. When I first opened the application, no details loaded for the sessions and the evaluation forms were blank. However, once I closed the other 20 apps that I was unconsciously, simultaneously running on my iPhone, EventBoard worked quite well.

I will confess that my first sight of some of the Millennials in our firm on any given morning during the retreat was in bed by the light of a smartphone furiously typing. Perhaps they were well on their way to the 50 or more text messages that 50% of Millennials surveyed will send in a day. But I can’t blame them, as the first thing I did every night and every morning while away was to text my family to say “Hi.”

Finally, we used our smartphones to play music enjoyed by the team as a whole. We took turns depending on who had a particular song we wanted to hear. No one had brought a portable speaker, and the van’s stereo system had no speakers in the passenger area, thus we had to improvise with one of those pairs of giant headphones that Millennials often sport to broadcast the music for all to hear. As a result, the music was a little tinny and not as loud as I would have liked. Nonetheless, it relieved the monotony of the road trip as we sang, hummed, and/or danced to music from all three generations and, more importantly I think, moved in harmony as a great team should.

What is the greatest success you’ve had since joining LWP?

Maintaining a successful firm even after crisis occurred when the Attorney was in a car accident.   A large portion of our success is the Actionstep platform and having the technical knowledge within the office to program and automate everything and staying in the black!

This is a cop-out, but they are all amazing in that they have assisted us to maintain even in crisis.   The way the stories tie to the Estate Plan Audit, and then the Vision Clarifier have been a massive support in reminding clients of their goals in follow-ups.

How has being part of LWP impacted your team and your practice?

Being able to call for help.  The greatest example is one, Nedra’s constant ideas, two, Candace’s drive to move forward, and most of all, three, without Molly “encouraging”, e.g. “do it”, with regard to us doing Vision’s without the Attorney, we would have had to close the office after Debbie’s accident.

Share something about yourself that most people don’t know about you.

Beth is a very experienced database and lean management trainer!  Beth is a bit of a recluse.

Melissa worked for 14 years in daycare and this is her first office job and has surpassed any assistant we’ve ever had in the office.  Melissa is a HUGE prankster.

John has extensive experience in programming and automates everything in Actionstep beyond its basic programming.  John has played the piano for 30 years.

Debbie is a successful attorney with a secret passion for beading!  She makes most of her own jewelry.

Terry is retired, and was an instructor helicopter with the Guard before joining our team.  He makes a mean chocolate chip cookie for the clients.

What is your favorite book and how did it impact your life?

John – Technical programming books.  It has advanced his piano recording and office efficiency.

Melissa – To Kill a Mockingbird – It makes her sound more sophisticated when asked what her favorite book is.

Beth – Machine that Changed the World – Has simplified her life both at home and work through lean management.

Who Has Your Back?

I was sitting in a hotel room in Florida at 11:24 in the morning when my cousin called.  My aunt was in the hospital after having a stroke and learning she has a brain tumor. It was Saturday and the hospital wanted to discharge her to a rehabilitation facility on Monday.  Like many of our clients, my aunt had completed a will in the 1980s but did not have a financial power of attorney or health care directive.  Knowing that I am an elder care attorney, my cousin reached out to me for help.

Bigstock-Typewriter-With-Special-Button-74518390We spent almost an hour on the phone outlining priority actions.  Although I could educate my cousin and tell her what needs to be done, I could not personally help because I don’t know the laws in Texas, where I am from and where my aunt lives. Fortunately, I do know people.

Immediately I reached out to my friend and colleague, Sandra Ard, from Ard Law Firm, PLLC, www.ArdLawFirm.com, in Dickinson, Texas.  After returning home from getting her nails done, Sandy spent the rest of her Saturday afternoon preparing legal documents and driving to Galveston to meet my aunt at the hospital to execute them.  Sandy could have said, “Call me on Monday.” But she didn’t.

I would not expect any lawyer, even a friend, to take such remarkable measures for a client.  I did not expect Sandy to do so just because it was my family member who needed help, but I was hopeful.

Is Your Practice … Uhmmmm, Easy?

Many lawyers are frustrated when it comes to operating the "business" of their practice.  Law school taught us how to think critically and help people, but it did not teach us how to run a business.  As a result, much pain and long hours of work and frustration are created.  Balancing the needs of your clients and operating your business is one of the most frustrating elements of running a law practice.  The good news is, fixing it is not hard, it just requires a basic understanding you never got in law school.  Let's begin by identifying whether you have effective employees.  

Bigstock-Easy-Way-To-Success-73438723In coaching hundreds of law firms over the past 15 years, I have a question I ask consistently: "Is it occurring?"  What does that mean?  Essentially, if what you want to be happening is happening, then it's occurring.  If what you want happening is not happening, then it's not occurring. Simple enough?  So let's analyze this in your practice.  If you're frustrated with a certain part of your business, like hiring employees, because it's not being done effectively, then it's not occurring.  If it's not occurring, then the person responsible for doing it does not have the proper skill set.  Unfortunately, in a small practice that's usually you.  So you must find others who know how to do it so you can get the employee hired effectively.  This can be someone in your firm, or you can reach out to others and outsource your need. (LWP has many system services for estate planning attorneys; that’s what distinguishes this organization from most others.) 

The interesting thing is, for those individuals you reach out to for help, it's really easy for them, which amazes most attorneys because we don't get it and it's so frustrating to us. (I personally hate it.)  But for those who have the skill set, it's easy and it occurs!  So as you look around your practice, if there's an area causing you pain, it is a clear message that you lack someone with a natural skill set to perform that task or duty.  If drafting is not happening effectively, then you need to get someone who does it easily.  They're out there and you can't stop until you find someone, because once you do, your life and your practice will change dramatically. 

In building companies over the last 15 years, the level of pain I have endured along the way sometimes was unbearable. But now, as I have reached a point where many of those companies are operating without me, I look back at what the key issues were that I had to overcome.  The answer?  It all came down to skill set and ease!

High Energy / Low Energy

Day One:  My family walked a mile to school for the fourth day of kindergarten. Since I was going out of town, the hugs were a little longer than usual. Before heading to the airport, I also walked my dog, since it would be his last one for three days. The flight was uneventful. I had rearranged my flight to arrive early so I could visit with my aunt in the hospital, where she is undergoing treatment for a brain tumor. Without treatment, the prognosis is six months to live. With treatment, it is 18 months. During our visit, I had to excuse myself for a very challenging business teleconference. When I returned, my aunt was tired.  I sat on her bed looking into her eyes for probably the last time; both of us were crying. An hour later, I was overlooking the beach while having dinner with a colleague. Then I went to bed.

Bigstock-Better-Worse-Roller-Coaster-10548788Day Two:  I awoke early to review my aunt’s financial situation and create a written plan, like I would for any client, to provide to my cousin over breakfast. We discussed ways to initiate difficult conversations. “Are there any specific goals you want to accomplish in the next six to 18 months?” “Is my aunt making choices based on what she wants, or what she believes others want?” “Where would she prefer to die, in a facility or at her home?”

Breakfast lasted right up until it was time for me to give a 45-minute presentation on veterans benefits for over 100 lawyers.  I stepped onto the stage and delivered a strong, fluid speech. Then, I immediately rushed to the airport to catch a flight to New York by way of Georgia, my home state, but I couldn’t stay long enough to see my family. Instead, I spoke with them via Facetime, and my daughter cried because she wanted me to tuck her into bed.  I arrived in New York just in time to slip into bed. Sleep was restless as usual, since I have insomnia.

How many highs and lows do we have throughout a day?  The two back-to back days described above are typical (other than finding out my aunt has a limited time to live).  They are typical for me, for my law office team members and for my clients.  We all go from one emotion to the next, from successes to challenges, from elated to deflated in moments, without taking time to absorb and reflect. Without taking time to celebrate or grieve.  We just stack our emotions on a pile like smashed cars to be recycled.

How does running from one event to the next affect our work product? Our customer service? Our communication and relations with others?  Our profitability and success? 

Negatively.

What can we do? 

First, recognize that you are running through highs and lows. When possible, try to group high-energy events together and low-energy events together. 

Second, pause between events for five minutes and sit with the residual emotions of what you just endured. If it was a success, celebrate – even if just in your mind you smile and say, “I did good.”  Or allow yourself to get upset and release frustration, if necessary, even if just in your mind you scowl and say, “This is not what I intended. I must do better; I cannot let that happen again.” Then clear it away and prepare for the next event, to be completely present and not affected by the prior event.

Third, understand that you are not the only one with days like this. Be there for your team and your clients when they have highs and lows.  Support them.  Your support will enrich your relationships, which in turn will produce better customer service and work product. Lastly, just slow down and be aware.  We see much better when the pace we are traveling is not blurred with speed.

Good News – Bad News!

It takes A LOT to shock me, but I’ve just confirmed that the Practice With Purpose portion of our October Retreat has officially SOLD OUT only two weeks into registration.

With that crazy update comes good and bad news.

We are in the largest room possible and there is nothing else available at our venue.  We are not allowed to add seats either because of fire laws.  So unfortunately, we have to close registration down for this portion of the program.

Now, for the good news.

There is absolutely no substitute for sitting in a large conference room with people who do the same thing you do, day-after-day.  They “get” your challenges because they face similar ones.

The Art Of Surrender

“Let go or be dragged.” ~ Zen proverb

Four weeks ago the LWP partners began our customary quarterly partners retreat at a Hyatt in Atlanta at 9 a.m. sharp. We began the day in customary fashion, after Dave ensured that we had a mealtime plan, by analyzing our quarterly goals. We carefully reviewed who is doing what to reach goal, our money plan from the previous quarter and then where we have nobody leading.

Bigstock-White-flag-old-style-vector-54229970Like all businesses, marketing was where the spotlight shined loud and clear. What I appreciate about our collective skill sets is how quickly we are able to shift from driver mode right into solution mode. We revisited hiring outside consultants, as we have done in the past. It would take at least six months to get them up and running; plus, how do we find someone who understands the dynamic of an estate and elder law firm vs. a hunt and kill mindset at all cost?

At the end of the day we agreed that I would go full-time into marketing. I am naturally the best person to lead this, and the organization needs me to lead it, own it and nurture it.

I’m not going to lie – I resisted. Hard. My control freak showed up immediately:  “I know (control freaks always know best) that X will happen,” “Who’s going to lead Y,” “Who’s going to coach Z,” “We have been making such great progress on Z, I can’t just abandon ’em now.”

I finally GOT IT. I have been working with team members for 17 years, hearing the exact same words when their attorneys ask them to step up and replace themselves. I never fully understood what the root of the resistance was. Now I get it.

The hesitation does not stem solely from fear and the unknown aspects of change. It’s not just fear of what’s next and whether the team member can actually pull it off. Sure, the uncertainty is a big piece, and fear of failure has a giant room at the inn as well.  But in all honesty, the biggest piece comes down to leaving with a feeling of abandonment – abandoning the team, the clients and what you have taken personal pride in developing and perfecting. It’s the essence of, “I said I would do this and I gave it my all and now I’m leaving the baby. Do they have all they need to make certain this doesn’t nosedive?”

So we resist, we justify that “they need me” and we attempt to control the situation, instead of investing in how we are going to become the next, better version of ourselves and create a better version of the business. Dang it, there it is again, that 2mm shift.

But if we can detach from the logistics of how what we are currently doing will get done, and anchor to how we are going to step into our new role/world/life, the art of surrendering begins.

As soon as I got on the plane, I got to work. I looked at what I am doing non-marketing-related and to whom I can responsibly shift it over. I quickly came up with a suggested transition plan. I pulled out our marketing plan, the money plan, and realized not only that I can do this, but that I am very much the best person for the job. I can do this, and I will do this. I sat for the next two hours and 20 minutes while trapped on the plane and mentally surrendered to letting go of what was, to allow the new reality to permeate, and to embrace the sense of excitement, along with a healthy level of challenge.

But I couldn’t do it without detaching first and allowing for the possibility of what’s next to unfold. Yes, I know this is a skill and it must be practiced, daily. And it is never, ever mastered. But like my good friend Candee always says, “You must be willing to try it on.”

That honestly is the process for giving up control and the art of surrendering. It’s simply one small step (emotions, logistics and movement) at a time. And then you can course a realistic present and a future path and plan. Eventually you find your new normal.  And that’s really the story of growth.

Leadership

The term “leadership” is all the rage on social media these days – and it is definitely on most entrepreneurs’ wish lists. Yet when I ask people what leadership means to them, I often hear some multifaceted variation that’s equivalent to dismissing the need for relationship. In this day and age I have actually heard, “People today should be thankful they have a job in this economy.” I can assure you, in no way, shape or form is this leadership.

It’s so much more about finding leadership within that will get the work out and the consistent cash flow in. And fast. It is Mindfulness + Self Awareness + Social Awareness + Self Management.

Self-Awareness is showing up on time with empowering energy, and general concern for everyone’s time and experience while they are with you. Social Awareness is supporting your team, showing up focused and present, keeping your word and taking full responsibility for how you show up in the world. Self-Management is showing up prepared, projecting onward motion, without an unstable tone combined with tension demands. Even though most leaders are active, you don’t want to come off harsh, with a self-serving need to push your own agenda. The minute you become disengaged and start pointing at them, you resign from being a leader.

Leadership is not strength or force.  It is not based on “old school” thinking that smart is good enough and that great leaders are tough and can always muscle through – no one can sustain continuous strain. It is not survival of the fittest. Leadership does not manage from a place of control – team has to go along to get along and must stay in the box built. It is not from a place of personal position – sway whichever way, defer decisions or create fear based on authority.

Every great leader touches your head to make you think, touches your heart to make you feel and always gives you something to carry with you later, a walk-away message. The way I see leadership, here are some of the key tenets:

  • Never dehumanizes, but fills up, guides, includes and creates
  • Tend and befriend vs. command and control
    • Willing to live the examined life, a spiritual seeker
    • How we do what we do is just as important as what we do
    • Emotional intelligence
    • Power is used to bring wisdom and clarity for others
    • Not forced, common practice
    • In order to empower, you have to give up your power
    • Of the people, for the people while honoring them for their conviction

Leaders have an ability to get people behind one another and bring out the best in each of them. They identify their own weaknesses, and provide solutions to increase efficiency and productivity. Never “Here’s what’s wrong, now solve it or we’ll be having a different conversation.” They are very much “part of.” They have the ability to be the manager and make sure that tasks are getting completed, with an empowering leadership element in that. It usually is very difficult to be manager/leader at the same time, but true leaders can accomplish this at all times. They can verbalize the “hard” things to say, even when it hurts, because they are accurate and necessary for the growth and success of the company and the individuals in the company – even when they can’t see it. 

A leader is loyal and committed, with a reassuring way that permits people to let go of panic and trust in themselves to accomplish their goals.  A leader has the ability to help individuals sort through a tremendous amount of information and put them on a path of clarity and direction, with specific short-term steps that lead to long-term success.

You know you have great leadership when you have engaged employees who are innovative and empowered to get the job done while never being afraid to use their voice!
